During his last month in office Pres. Bush commuted the 10 year prison sentences of border patrol agents Ignacio Ramos and Jose Compean. While I am extremely happy for them and their families this situation still needs to be corrected. They should not have needed their sentences commuted, they should have been exonerated, as they were merely doing a job that they are paid to do.

They were accused of shooting admitted drug smuggler Osvaldo Aldrete Davila in the ass as he fled across the Rio Grande , away from an abandoned van load of marijuana. The border agents argued during their trials that they believed the smuggler was armed and that they shot him in self defense. What a weak defense, I mean really, what reasonable man would think that an illegal who just snuck across our border with a van full of weed would be armed??

The prosecutor in the case said there was no evidence linking the smuggler to the van of marijuana. (I guess we are supposed to believe that there just happened to be a abandoned van full of marijuana there in the dessert and the suspect just happened to be near it.) The prosecutor also said the border agents didn’t report the shooting and tampered with evidence by picking up several spent shell casings. You know I am really trying to see the prosecutor point of view here but I can quite get my head up my ass that far.

The agents were fired after their convictions on several charges, including assault with a dangerous weapon and with serious bodily injury, violation of civil rights and obstruction of justice. All their convictions, except obstruction of justice, were upheld on appeal.

Assualt with a dangerous weapon, let’s think about that for a moment shall we?? Even IF Davila didn’t have a weapon, even if the van full of drugs wasn’t is, (right there’s a hell of a stretch) was he or was he not breaking the law when he entered this county illegally?? Do you really need anymore evidence to prove to you that the judicial system is out of control when law enforcement agents sit in jail for doing their jobs??!!
